NexCard Hardware Warranty Policy

1. PURPOSE, SCOPE, AND LEGAL FOUNDATION

1.1 Purpose

This NexCard Hardware Warranty Policy ("Warranty") outlines the specific terms, conditions, limitations, and mandatory procedures for warranty claims related to the physical NexCard NFC card ("Hardware") purchased by End Users. This Warranty is an integral part of the NexCard End User License Agreement (EULA).

1.2 Scope

This Warranty applies exclusively to the physical Hardware manufactured by or for UAS/Nexbit Tech PH and is limited to defects arising from the manufacturing process, materials, or workmanship.

1.3 Acceptance

By purchasing, activating, or using the Hardware, the User acknowledges and agrees to be bound by the provisions contained herein, which represent the exclusive remedy available to the User for any hardware defects.

2. WARRANTY COVERAGE AND PERIOD

2.1 Warranty Period

UAS warrants that the physical NexCard Hardware is free from manufacturing defects in materials and workmanship under normal use for a period of twelve (12) months (one year).

  • Warranty Commencement: The Warranty Period begins on the original date of purchase by the End User from an authorized channel, as evidenced by a valid proof of purchase (receipt or order number).

2.2 Covered Defects

This Warranty covers failure of the Hardware to perform its intended NFC function under conditions of normal use, specifically including:

  • Defective NFC chip (non-scanning or non-detectable by compatible devices).
  • Failure of the embedded Unique Identifier (UID) to link to the User's profile.
  • Structural defects (e.g., severe print defects, warping, or delamination) evident upon delivery or manifesting during normal use.

2.3 Eligibility

This Warranty applies only to original, unaltered, and unmodified NexCard units purchased directly from:

  • Nexbit Tech PH (official website/app).
  • Nexbit Tech PH official distribution channels.
  • Authorized resellers or corporate partners.

3. WARRANTY EXCLUSIONS AND VOID CONDITIONS

This Warranty is VOID and does NOT cover the following conditions or types of damage.

3.1 User-Caused Damage and Misuse

  • Physical damage including scratches, chips, dents, tearing, cracking, folding, or forceful bending of the card.
  • Damage resulting from improper handling, storage, or exposure (e.g., exposure to excessive heat, liquids, moisture, corrosive chemicals, or magnetic fields).
  • Damage caused by accidents, negligence, or unauthorized use, including improper placement in a wallet with sharp objects or metal plates.

3.2 Wear and Tear

  • Normal cosmetic wear and tear, including color fading, minor print abrasions, or surface scratches resulting from regular, intended use.

3.3 Unauthorized Modification

  • Any attempt by the User or a third party to rewrite, reprogram, clone, or otherwise tamper with the NFC chip, UID, or embedded technology.
  • Structural alteration, including applying non-removable stickers, adhesives, lamination, or drilling holes.

3.4 Loss and External Factors

  • Loss, theft, or misplacement of the physical NexCard.
  • Inability to scan due to incompatible third-party devices, NFC-disabled or restricted smartphones, or operating system limitations outside the Provider's control.
  • Failure to provide the original proof of purchase.

4. WARRANTY REMEDY (SOLE AND EXCLUSIVE)

4.1 Replacement

If a Hardware defect is confirmed and validated by the Provider under the terms of this Warranty, the User's sole and exclusive remedy shall be:

  • A one-time replacement card of the same model and current design, or a functionally equivalent model if the original is discontinued.
  • No cash refunds or credit will be issued for confirmed Hardware defects.

4.2 Replacement Conditions

The replacement card may be subject to minor variations due to updated branding, design changes, or print batches.

4.3 Shipping Costs

  • Return Shipping (Initial): The cost of shipping the defective Hardware back to the Provider for inspection (Section 6.3) is initially shouldered by the User.
  • Replacement Shipping (Approved Claim): If the defect is confirmed and the claim is approved, the cost of shipping the replacement card to the User will be shouldered by the Provider.

5. CLAIM PROCESS AND VALIDATION

5.1 Submission of Warranty Request

Users must initiate a claim by contacting the Provider within the Warranty Period:

  • Email: nexbit@uas.com.ph
  • Subject: Warranty Claim – NexCard [Order Number]
  • Mandatory Inclusion: Full name, Order Number/Proof of Purchase, Date of Purchase, detailed description of the issue, and clear photos/videos demonstrating the defect.

5.2 Initial Assessment

Nexbit Tech PH will conduct an initial assessment of the submitted documentation within five (5) to seven (7) business days.

5.3 Physical Inspection

If the initial documentation is inconclusive, UAS may require the User to return the defective Hardware for physical inspection. The Provider will issue a Return Merchandise Authorization (RMA) number which must be included with the return.

5.4 Final Decision

Upon completion of the inspection, the Provider will issue an Approval or Denial of the claim, along with a written explanation detailing the basis for the decision (e.g., confirmation of manufacturing defect vs. user-caused damage).

6. DISCLAIMER AND LIMITATION OF LIABILITY

6.1 Disclaimer of Implied Warranties

EXCEPT FOR THE EXPRESS WARRANTY SET FORTH IN SECTION 2.1, THE HARDWARE IS PROVIDED "AS IS." THE PROVIDER EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

6.2 Limitation of Liability

To the maximum extent permitted by the laws of the Republic of the Philippines, the Provider shall NOT be liable for any indirect, incidental, punitive, special, or consequential damages (including, but not limited to, lost data or revenue) arising out of or related to this Warranty or the use or inability to use the Hardware.

6.3 Maximum Liability

The Provider's total aggregate liability for any claim under this Warranty is strictly limited to the replacement of the defective NexCard unit as specified in Section 4.1.

7. GENERAL LEGAL PROVISIONS

7.1 Governing Law and Jurisdiction

This Warranty shall be governed by and interpreted in accordance with the laws of the Republic of the Philippines, including, but not limited to, the Consumer Act of the Philippines (R.A. 7394). Any disputes arising under this Warranty shall be resolved exclusively in the courts located in Pasig City, Republic of the Philippines.

7.2 Severability

If any provision of this Warranty is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall remain in full force and effect.

7.3 Amendments

UAS reserves the unconditional right to update or modify this Warranty at any time. The latest version will be posted on official Nexbit Tech PH channels, and continued use of the Services signifies acceptance of the revised terms.
